Legal experts believe that Sheikh Hasina has no constitutional right to hold the post of Prime Minister after the President dissolved the Constituent Assembly. Moreover, they believe that the statement that Sheikh Hasina is now the prime minister has no legal basis.
Regarding the controversy over the resignation of former Prime Minister Sheikh Hasina, senior advocate Subrata Chowdhury told Voice of America, ‘The President has dissolved the Parliament, the Council of Ministers has been dissolved. Then how is a prime minister? After the dissolution of the Parliament, according to the Constitution, everything before is cancelled.’
Similarly, Senior Advocate Ahsanul Karim told Voice of America, “Since the President has dissolved Parliament and the President himself has said that the Prime Minister has resigned, these debates are meaningless.”
Subrata Chowdhury also said, ‘If the President dissolves the Parliament, nothing remains. Only the Speaker of Parliament remains until the next Parliament. Now the Speaker has also voluntarily resigned.’
During the liberation war, the expatriate government assigned Professor Yusuf Ali to administer the oath, he said, “Now when the next election is held, the elected members of parliament will meet and decide to appoint someone to administer the oath.”
On the other hand, there is no specific legal proof that Sheikh Hasina is the prime minister constitutionally, she has claimed it herself, said Advocate Ahsanul Karim.
Ahsanul Karim added, “When the President has undisputedly dissolved Parliament, there is no need to notify Sheikh Hasina’s resignation.”
Demand the removal of the President
In response to President Md Sahabuddin’s statement to Manavzamin editor Matiur Rahman Chowdhury regarding the resignation of former Prime Minister Sheikh Hasina, the anti-discrimination student movement has demanded her removal.
Hasnat Abdullah, one of the co-ordinators of the anti-discrimination student movement, addressed President Md Sahabuddin in a protest rally organized on Monday (October 21) night at the foot of Dhaka University’s Raju sculpture to prosecute those involved in the attack on students by the Chhatra League and to ban the Chhatra League in Chittagong University. Anti-discrimination student movement coordinator Abdul Hannan Masood said on Monday (October 21) that a program will be given to remove the president by Tuesday.
Besides, the anti-discrimination student movement protested in several places including Begum Rokeya University and Cox’s Bazar to demand the removal of President Md Sahabuddin.
